Coaching Agreement

The Parties to this agreement for the provision of coaching services (“Agreement”) are the Client and Dr. Bernie.
Terms and Conditions
The term of this Coaching Agreement is for the duration of services received (whether new or returning client). In the event that the client ends or suspends coaching, the client will be required to agree to the Coaching Agreement before resuming services.
Fees: $___(A)___ per Session for the initial term.
Schedule: The Session dates will be scheduled as soon as possible following the first Session.
Sessions will typically be approximately 45-50 minutes in length, unless a longer session is agreed to in advance by the Coach and Client.
The Sessions may be conducted in person, through video conference or over the phone as determined appropriate by the Client and Coach.
Scheduling will be discussed in the initial session. Clients can choose to initially have regularly scheduled sessions or choose to schedule as needed. Client and Coach understand that conflicts may occur and will accommodate schedule changes with 24-hour advance notice, or with shorter notice in the rare event of a critical business interruption or emergency. Misuse of this policy may result in termination of services.
Payment is required prior to receiving service unless a previous arrangement has been made. Payment may be made through credit card or through PayPal, unless otherwise agreed by the Parties.
Client understands and agrees that the following are necessary for the Coaching to be as successful as possible:
Client intent to change and motivation for change will be significant.
Client will make every effort to ensure his or her peak mental, physical and emotional state for each Session.
Client agrees to notify Coach in the event that their functioning impairs their ability to work on coaching goals. Examples include but are not limited to changes in physical or mental health such as injury or depression. Coaching services may be suspended or terminated by the Coach in such cases at the Coach's discretion.
Client understands that the goal achievement in the coaching process will include the identification of key behaviors for change which may require the assistance of key stakeholders identified by client.
Client is ready to work and receive feedback from his or her key stakeholders. Client is willing to try new ways of learning or different ways of doing/approaching things.
Client is willing to be honest and open, will keep commitments and will inform the Coach immediately if an approach or process is not working for Client.
Client is willing to explore, challenge and change thoughts and behaviors that Client recognizes as counterproductive to the achievement of his or her goals.
Client understands that the Coach will be focused on helping the Client achieve the goals the Client has identified for Coaching and in the best interests of Client as a whole.
Client understands the need to plan the end of the Coaching relationship in advance to allow for appropriate closure and wrap-up.
Client understands and accepts issues related to technology. Electronic communication and video conferencing are available and can be helpful tools in coaching; however, there are many ways that technology issues might impact tele-coaching. For example, technology may stop working during a session, other people might be able to get access to our private conversation, or stored data could be accessed by unauthorized people or companies. If our video connection is disconnected, please try to join the video conference again within 2 or 3 minutes. If we are unable to reconnect through video, please call my direct phone number to continue the session or send an email to reschedule.
1. Dr. Bernie’s Commitment:
Dr. Bernie will provide the coaching sessions.
Dr. Bernie will provide coaching that is a professional client relationship designed to facilitate the creation and development of personal, professional or business goals and to develop and assist the Client in carrying out a plan for behavioral change to move toward those goals.
E-mails are welcome between sessions if Client would like to share a success, ask questions or discuss an issue. The Coach will respond as soon as possible but generally not later than within 24 hours.
2. Client Commitment:
Client or Company agree to pay the fees as set out in this Agreement.
Client agrees to video conference, call or meet the Coach at the specified times.
Client agrees to be honest, open and truly committed to change. Client accepts responsibility for his or her actions and will positively accept and appreciate feedback from key stakeholders.
3. Coaching:
Client enters into this Agreement with the full understanding that he or she is responsible for creating his or her own results. Client understands that success in meeting goals (in whole or part) cannot be guaranteed and no warranties are given.
Client is aware that coaching is not counseling, psychotherapy, psychoanalysis or any other form of mental health care or treatment. Client understands that the Coach is not functioning as a mental health professional and that Coaching is not intended as a replacement for counseling, psychiatric intervention, treatment for mental illness, or for recovery from any type of past abuse or trauma.
Client agrees that Coaching is not a substitute for and that the Coach is not providing legal, medical, financial or other professional advice or services.
If appropriate, Client will seek independent professional guidance in the areas indicated in 3.2 and 3.3 and Client understands that all decisions and actions in these areas are his or her sole responsibility.
4. Client Agenda:
The Session agenda belongs to Client. If the Session is not heading in the desired direction, if the Coach says anything Client does not feel comfortable with or if Client has a concern with the way the Sessions are proceeding Client will let the Coach know immediately.
5. Ethics and Confidentiality:
As a Certifiied Professional Coach, the Coach follows the coaching ethics and rules or professional responsibility. If the Client has not received a copy of the coaching ethics and would like one, the Client may download the BCE Code of Ethics here..
Any notes the Coach makes during the Session or about the Client are kept confidential, to the extent permitted by law. Client acknowledges that electronic, telephone and video communications may be unknowingly intercepted by others and will not ensure the same levels of privacy or confidentiality as in person meetings.
The Coach will not use or disclose the information Client shares during Client Sessions, except as authorized by Client or as required by law, or in order to prevent harm to the Client or third parties.
Client understands that on occasion the Coach may anonymously share generalized information for training or consultation purposes with other Coaching professionals. Client identity and any information that could lead to Client identification will remain entirely confidential.
Limits of Confidentiality: As your life coach, your privacy is of utmost importance to me. The information shared during coaching sessions is generally kept confidential to create a safe and trusting environment. However, there are some legal and ethical limits to this confidentiality. These include situations where there is a risk of harm to yourself or others, suspicion of abuse or neglect of a child, elderly, or vulnerable person, or if we are required by a court order to disclose information. While these instances are rare, they are important to understand as part of my commitment to your safety and the ethical standards of my practice. 6. Admin:
The Session may be refused if payment has not been made as required by this Agreement.
Where it is necessary for either Client or the Coach to reschedule a Session, this will be done at least 24 hours before the scheduled Session, or with shorter notice in the rare event of a critical business conflict or emergency.
Client will be charged for missed Sessions, at the normal session rate, if the missed sessions are not rescheduled in accordance with this agreement, except in exceptional circumstances (at the Coach’s discretion).
If Client is late for a Session, the Session will complete at the scheduled time.
7. Termination:
Client or Dr. Bernie may cancel this Agreement in writing (in session, by email or phone). In the event that Client owes money to Dr. Bernie at the time of cancellation, full payment will become due at the time of cancellation.
In the unlikely event that this Agreement is cancelled before prepaid Sessions have been completed, Dr. Bernie will refund Client for the prepaid but not yet provided Sessions.
Upon termination of this Agreement Dr. Bernie and Client will have no obligation to continue Sessions.
8. General:
Client and/or Company will not hold Dr. Bernie liable for any loss or cost incurred by Client (or any person related to Client) or the Company. Client and/or Company will indemnify Dr. Bernie in the event of any such claim.
Except as expressly set out in this Agreement the Coach and Dr. Bernie will have no liability to Client or the Company. This Agreement reflects the entire agreement and understanding between Client and/or Company and Dr. Bernie regarding the matters in this Agreement.
